These terms govern your use of the NeuroGut AI mobile app (the "App"), operated by Bishopp Lab Pty Ltd (ABN 54 695 338 946, ACN 695 338 946) ("we", "us"). By downloading or using the App, you agree to these terms.
1. What NeuroGut AI is
NeuroGut AI is a wellness biofeedback tool. It uses your smartphone's microphone and motion sensors to generate biomarkers (such as heart rate, breathing rate, and a gut motility score) for self-awareness and general wellness. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. If you have a medical concern, consult a qualified healthcare professional.
2. Eligibility
You must be at least 16 years old to use the App. If you are using the App on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.
3. Subscriptions and billing
- The App offers a free tier with limited features, and a Premium subscription at $9.99 USD / month or $99 USD / year (local equivalents may apply).
- New users may start a 14-day free trial of Premium. Payment is collected by Apple App Store or Google Play at trial start; you will be charged for the subscription period unless you cancel before the trial ends.
- Subscriptions renew automatically at the end of each period. You can cancel anytime from your App Store / Google Play subscription settings — cancellation takes effect at the end of the current paid period.
- Refund policies are governed by Apple App Store or Google Play terms. We do not process refunds directly.
4. Your content and data
By default, audio recordings made in the App stay on your device. You can optionally share recordings to support gut-brain research or help improve NeuroGut's AI. Shared recordings and measurements are uploaded securely and used only for the choices you selected. Biomarker values may also be sent to our backend for AI coaching. 5. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App to provide medical advice or services to third parties
- Use the App in any way that violates applicable law or regulation
- Attempt to interfere with or disrupt our backend services or other users
6. Intellectual property
The App, including its software, algorithms, designs, and content, is the property of Bishopp Lab Pty Ltd and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes as long as you comply with these terms.
7. No warranty
The App is provided "as is". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of fitness for a particular purpose, accuracy, or uninterrupted availability. Biomarker values and coaching content are for general wellness only and are not guaranteed to be clinically accurate.
8. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with your use of the App shall not exceed the amount you paid us for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Nothing in these terms excludes any rights or remedies you may have under the Australian Consumer Law that cannot be excluded by contract.
9. Termination
We may suspend or terminate your access to the App at any time if you breach these terms. You may stop using the App at any time by deleting it. Cancellation of a paid subscription is handled via your App Store or Google Play settings.
10. Changes to these terms
We may update these terms from time to time. Material changes will be notified within the App. Continued use after changes constitutes acceptance.
11. Governing law
These terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland, unless applicable law provides otherwise.
